Date: Fri, 18 Sep 1992 12:21:00 -0500 RESOLUTION NO. 19613 A RESOLUTION DEDICATING THE USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, A RIGHT-OF-WAY FOR THE CONSTRUCTION OF THE CENTRAL AVENUE BRIDGE BY THE STATE OF TENNESSEE. _________________________ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the use of certain property owned by the City of Chattanooga, more particularly described herein, be and is hereby dedicated as a right-of-way for the construction of the Central Avenue Bridge by the State of Tennessee. Said property within this dedication of use is described as follows: TRACT ONE PARCEL NO. 1: Beginning at a point where the existing west right-of-way line of Central Avenue intersects the north right-of-way line of the C.S.X. Railroad Company; thence westwardly fifty-seven (57) feet + along the north right-of-way line of C.S.X. Railroad Company to a point of intersection with the proposed right-of-way line of Highway Project BRM-4417(1), fifty-three and zero tenths (53.0) feet left of Central Avenue centerline station 100 + 80 +; thence North 26 degrees 30 minutes East one hundred forty-two (142) feet + along the proposed right-of-way line of the highway project to a point fifty-three and zero tenths (53.0) feet left of Central Avenue centerline station 102 + 22; thence North 63 degrees 30 minutes West nineteen and zero tenths (19.0) feet along said proposed right-of-way line to a point seventy-two (72) feet left of Central Avenue centerline station 102 + 22; thence North 26 degrees 30 minutes East twelve (12) feet along said proposed right-of-way line to a point seventy-two (72) feet left of Central Avenue centerline station 102 + 34; thence South 63 degrees 30 minutes East thirty-four and five tenths (34.5) feet along said proposed right-of-way line to a point thirty-seven and five tenths (37.5) feet left of Central Avenue centerline station 102 + 34; thence North 26 degrees 30 minutes East sixty-nine and forty-nine hundredths (69.49) feet to a point in the property line separating the City of Chattanooga and the Elvin C. Hodge properties, thirty-seven and five tenths (37.5) feet left of Central Avenue centerline station 103 + 03.49; thence South 62 degrees 45 minutes East thirty-two (32) feet along said property line to a point in the existing west right-of-way line of Central Avenue; thence southwardly one hundred ninety-seven (197) feet + along the present west right-of-way line of Central Avenue to the point of beginning, containing, 0.216 acre, more or less. The Tennessee Department of Transportation, its employees, contractors and assignees, are hereby granted a temporary easement on the above-described property for the purpose of severing those parts of improvement located on the land described herein. The City of Chattanooga agrees to leave the land herein in its present condition prior to removal of any bridge improvements from it by the Tennessee Department of Transportation in connection with the Central Avenue Bridge replacement project. PARCEL NO. 2: Beginning at a point in the proposed west right-of-way line of Highway Project BRM-4417(1), where said right-of-way line intersects the property line separating the City of Chattanooga and the Elvin C. Hodge properties, thirty-seven and five tenths (37.5) feet left of Central Avenue centerline station 103 + 03.49; thence South 26 degrees 30 minutes West sixty-nine and forty-nine hundredths (69.49) feet along said proposed right-of-way line to a point thirty-seven and five tenths (37.5) feet left of Central Avenue centerline station 102 + 34; thence North 63 degrees 30 minutes West thirty-four and five tenths (34.5) feet along said proposed right-of-way line to a point seventy-two (72) feet left of Central Avenue centerline station 102 + 34; thence northerly five (5) feet + along said proposed right-of-way line to a point; thence northeastwardly sixty-seven (67) feet + along said proposed slope easement line to a point in the property line separating the City of Chattanooga and the Elvin C. Hodge properties; thence South 62 degrees 45 minutes East twenty-six (26) feet + along said property line to the point of beginning, containing 2,362 square feet, more or less. The above described parcel of land is hereby conveyed as an easement for the construction of slopes outside the proposed right-of-way line. The land on which the slopes are to be constructed remains the property of the City of Chattanooga. This easement shall terminate upon the grading of said easement of the approximate plane of the highway or at such time as other construction is performed by the Tennessee Department of Transportation eliminating the need for the easement. PARCEL NO. 3: An irregularly shaped tract of land lying west of and adjacent to the slope easement of Highway Project BRM-4417(1) described in Parcel 2 above, extending from the C.S.X. Railroad Company's north right-of-way line to the City of Chattanooga's north property line, and having widths varying from three (3) feet + to fifteen (15) feet, and containing 2,102 square feet, more or less. The above described parcel of land is hereby conveyed as a temporary easement for a work area. The title to the above described land remains vested in the City of Chattanooga and is to be used by the State of Tennessee, its contractors or assigns for a period of three (3) years from and after the commencement of construction. REFERENCE: All boundaries and descriptions as shown on plans for Highway Project No. BRM-4417(1) Right-of-Way on file in the Office of the Department of Transportation in Nashville, Tennessee. TRACT TWO PARCEL NO. 1: Being a parcel of land south of, and adjacent to, the south right-of-way line of Founder's Alley on Highway Project No. BRM-4417(1), beginning at the City's east property line extending twenty (20) feet + along said alley right-of-way line to an ending point, varying in width from three (3) feet + to zero (0) feet +, and containing 50 square feet, more or less. The above described parcel of land is hereby conveyed as an easement for the construction of slopes outside the proposed right-of-way line. The land on which the slopes are to be constructed remains the property of the City of Chattanooga. This easement shall terminate upon the grading of said easement of the approximate plane of the highway or at such time as other construction is performed by the Tennessee Department of Transportation eliminating the need for the easement. PARCEL NO. 2: Being a strip of land south of, and adjacent to, the above described Parcel No. 1 and the existing south right-of-way line of Founder's Alley on Highway Project No. BRM-4417(1), beginning at the City's east property line and extending fifty-three (53) feet + along said alley right-of-way line to an ending point, having a width of five (5) feet, and containing 250 square feet, more or less. The above described parcel of land is hereby conveyed as a temporary easement for a work area. The title to the above described land remains vested in the City of Chattanooga and is to be used by the State of Tennessee, its contractors or assigns for a period of three (3) years from and after the commencement of construction.
